OVERVIEW

This Privacy Policy applies to the activities, products and services of the bndr Music International Limited Group of Companies trading as bndr (“bndr Music”, “we”, “us”, “our”) and its related bodies worldwide.

This Privacy Policy is intended to inform you about how we treat Personal Information that we collect, hold, use and disclose about you. We may also collect non-personal information for any purpose. If you do not agree to any part of this Privacy Policy, then you should stop accessing our services, including our applications (“bndr Service”)

bndr collects, holds, uses and discloses Personal Information that you voluntarily provide when applying or registering for a BNDR account. bndr may combine the information you provide voluntarily with other bndr or third parties to enhance your user experience.

By using bndr Services, you are entering into a binding agreement with us and are consenting to the use of your information as set out in this Privacy Policy. You unambiguously agree that we may collect, hold, use and disclose your information in the manner described below and in accordance with the terms described in this Privacy Policy.

We may allow our related entities, such as our subsidiaries, and their employees, to use and process your Personal Information in the same way and to the same extent that we are permitted to under this Privacy Policy. These related entities comply with the same obligations that we have to protect your Personal Information under this Privacy Policy.

WHAT CONSTITUTES
“PERSONAL INFORMATION”?

Personal Information is any information (including but not limited to numerical, alphabetical, graphic, photographic, sound, or any other type of information concerning an individual) or opinion (whether fact or not) which either identifies you or from which your identity can reasonably be determined, including in conjunction with other information to which a third party has or is likely to have access to.

Personal Information can only relate to human beings, and information about companies and other legal entities is not covered by the provisions of this Privacy Policy.

bndr does not collect private and sensitive Personal Information. Sensitive Personal Information includes (but is not limited to) racial or ethnic origin, academic qualifications, political opinions, personal identification numbers, political views, religious beliefs or affiliations, philosophical beliefs, trade union membership, sexual orientation or practices, criminal records, health information or biometric information.

REGISTRATION AND USAGE DATA

When you register with, or download the bndr Mobile Application and/or any other service or application of bndr, bndr may collect the following information in its server logs:

a) information that you provide when applying or registering for access to the bndr Service which may include your username, password, name, date of birth, gender, email address, home or work address, telephone number, as well as demographic information, such as your zip or postal code and country. bndr may also collect your IP-address during registration;

b) information that you voluntarily provide such as your telephone number, photographs, comments and posts, linked friends names and the like;

c) if you connect to the bndr Service through your Facebook account, you authorise us to collect your linked authentication details including but not limited to your username, name, email address and any other Personal Information available on or through your Facebook account including gender, country and town, profile pictures, photographs, and comments;

d) technical details of your computer and device system (including but not limited to the type and version of your browser, operating system, display resolution, JavaScript-settings and other items);

e) when you use the bndr Service on a mobile device, we may collect, hold, use and disclose different types of information about your location, including general information such as your IP address and zip or postal code, as well as more specific advice such as your GPS-based location. If you access the bndr Service through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer’s instructions for further details;

f) referrer URL (the address of the site that has been accessed before);

g) URL’s visited at www.bndrmusic.com;

h) hostname of your computer (IP address);

i) time and date of access; and

j) information about your interaction with the bndr Service, including searches, your use of such search results, selections which you make, downloads and streams that you initiate and/or complete, comments, reviews, your responses to advertisements, your interactions with persons who send you e-mails or other communications (the text of e-mails will not be processed), frequency with which you visit or use the bndr Service, length of usage, transaction related information, customer service usage, and details, interests and behaviour relating to transactions, products, services and activity in connection to the bndr Service.

We may also publish, disclose, and use information (other than Personal Information) for industry analysis, demographic profiling, marketing and advertising, and other business purposes.

COOKIES

When you use the bndr Service, our server may send small data files known as ‘cookies’ and other similar technologies to your device. We may also allow our business partners to use their cookies and other tracking technologies on the bndr Service platform. When you revisit or re-use the bndr Service, the cookies allow the site to recognize your browser, making your experience on the bndr Service more convenient and personal. The cookies may also store your preferences and other information that will allow us to tailor and simplify your experience when using the bndr Service.

For example, we may use cookies for the purposes of our own customer support, analytics, research, product development, fraud prevention, risk assessment, regulatory compliance, investigation, as well as to analyse how the bndr Service are used and accessed, or to target marketing and advertising to relevant demographics.

You have the option of changing your browser preferences to not allow cookies or even request your permission to send cookies. However, some bndr features may not function correctly without cookies enabled. Most of bndr’s features rely on the voluntary information you provide through your member profile, which you will have access to manage and update.

LINKED SERVICES

Please note that the bndr Service may be co-branded and offered in conjunction with other websites and/or services provided by unrelated third parties, and/or linked social media accounts such as Facebook and Twitter. If you register for (or use such a service), that other third party may also receive Personal Information collected in conjunction with the co-branded service. Other partners (i.e. advertising clients advertising on bndr, as well as those who provide for advertising supported entertainment products and other internet sites and services accessible via www.bndrmusic.com) may also collect data about you.

These parties have their own data protection guidelines, which are independent of this Privacy Policy. Further, if you integrate your bndr account with third party social media accounts, including Facebook, Twitter and the like, we may also collect, hold, use and disclose the Personal Information as set out above which you have made available either on or through your linked social media account. To change, customise, or limit access to or sharing of information collected from third party social media accounts, please visit your account settings on that service.

COMPETITIONS, PROMOTIONS OR SWEEPSTAKES

Additional information may also be collected if you choose to enter into any competitions, promotions or sweepstakes held in connection or through the bndr Service. That additional information may be combined with other account information, and may be collected, held, used and disclosed as described in this Privacy Policy.

USE OF PERSONAL INFORMATION

You expressly consent to bndr using the information we collect and hold, including your Personal Information, in the following ways:

a) to enable you to access and use the bndr Service;

b) to deliver and fulfil the bndr Service or carry out the transactions you have requested (including but not limited to downloads, streams, caching, purchases and resolution of issues which you encounter);

c) to provide, personalise and improve the bndr Service in line with our users’ needs and to display content and targeted advertising that is customised to their interests and preferences;

d) to ensure technical functioning of the bndr Service and analyse your use to the bndr Service, including your interaction with applications, advertising, products and services that are made available, linked to or offered by the bndr Service;

e) to administer rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by bndr or our partners;

f) to contact you directly about your use of the bndr Service, and/or your participation in rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by bndr or our partners;

g) to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties;

h) to communicate with you about the bndr Service such as service notices, reminders and administrative messages, push notifications, reminders, technical notices, updates, security alerts and information requested by you; and

i) to send you direct marketing, electronic direct marketing, and promotional messages and other information that may be of interest to you, including information about bndr or general promotions for partner campaigns, goods and services. You may opt out of receiving these notifications and correspondence at any time by clicking on the “Unsubscribe” link at the bottom of each communication, or alternatively by contacting BNDR support.

bndr has taken the necessary action to ensure that all personal information of Members is securely maintained. You may receive information, correspondence and push notifications from our partners and third party organisations. By using the bndr Service, you are expressly agreeing to bndr acting in this manner.

PUSH NOTIFICATIONS

bndr may send you push notifications about our content and playlists on the bndr Service.

You have the option of changing your preferences to not allow push notifications. See your device manufacturer’s instructions for further details.

SHARING INFORMATION

The bndr Service can integrate with various social media programs including Facebook, Instagram, Twitter and the like. Much of the information which you choose to be publically available shall be available by default, including your username, profile picture, any friends or playlists you are following, or those following you, your recent activity and any content you post or upload.

If you connect to the bndr Service or download the bndr Application using your Facebook account or other third party social media service, bndr may automatically share your recent activity within that linked third party service, including any Content you have accessed, followed or commented on. You acknowledge and agree that Facebook’s or other third parties use of any information you post or which is collected from you is governed by their privacy policies and that bndr’s use of that information is governed by this Privacy Policy.

bndr occasionally employs third parties to provide services on its behalf, such as handling the bandwidth and storage necessary to perform the bndr Services, or performing statistical analysis. The access of such parties to your Personal Information will be limited to the data they need in order to deliver the service.

bndr may also share information in order to obtain content from third parties, analyse usage patterns, provide demographic information, assist in design of advertising campaigns and other similar uses that will facilitate third party contacts in appropriate cases with parties selected by bndr, as well as to prevent, investigate or take action regarding suspected fraud and other illegal activities, as well as situations involving potential threats to the physical safety of any person and violations of bndr’s Terms of Service.

We may access and/or disclose your Personal Information if we, in our sole discretion, deem it necessary to:

a) comply with applicable laws; or

b) respond to subpoenas, court orders, or legal process; or

c) to establish or exercise our legal rights or to defend ourselves against legal claims.

We may provide the information which we collect to our successors and assigns in the event that we transfer, sell or dispose of all or any portion of our business and the information is relevant to that business segment.

bndr may also share your information to third parties in the following situations:

a) to respond to any relevant legal court order or subpoena, and/or in order to comply with any applicable law;

b) to protect the safety of any person;

c) to enforce bndr’s Terms of Service;

d) to prevent, investigate or address fraud, security or technical issues;

e) in the event of a merger, acquisition or sale of part or all of the bndr Group;

f) to advise our partners of the usage of the bndr Service, in the form of non-personal statistics and data; and

g) if you expressly opt in to having your data shared.

You understand and agree that the privacy policies of any third party will govern their use of the information that we share with them.

TRANSFER TO OTHER COUNTRIES

bndr may collect, hold, use, disclose or process your information, including Personal Information, on servers located in a number of countries. Accordingly, bndr may share your information with other related companies for the purpose of them carrying out any of the activities specified in this Privacy Policy. bndr may also subcontract to or share your information with third parties located in countries, other than your home country. Please note that laws vary from jurisdiction to jurisdiction, and so the privacy laws applicable to the places where your information is transferred or collected, held, used, disclosed or processed in, may be different from the privacy laws applicable to the place where you are a resident. bndr will use reasonable endeavours to ensure a comparable standard of protection is accorded to personal data that may be transferred overseas. You expressly consent to your information being used as set out in this section and Privacy Policy.

STORAGE OF INFORMATION

We will hold your Personal Information for the period necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law, and in any event for as long as you continue to use the bndr Service.

CAN YOU OBJECT TO GIVING YOUR PERSONAL INFORMATION?

Should you choose to use the bndr Service, we will require your Personal Information so that we are able to provide the services.

CAN YOU ACCESS YOUR PERSONAL INFORMATION?

You may request access to your Personal Information at any time, and we will provide access to your information. In order to respond to your request, we may require the following information to be provided:

a) your name and address;

b) your contact telephone number(s); and

c) your bndr username.

This service is usually provided free of charge and we ask that the request be made in writing. Should the information you require be held in our archives, there may be a small administration fee charged to assist with meeting this cost. Prior to acting upon your request we will advise you of any fees which may be payable.

We will act on all such requests as soon as reasonably possible on receipt of the request.

UPDATING YOUR PERSONAL INFORMATION

We will take steps to ensure that your Personal Information is accurate, up to date and complete, and to update information where we are advised of changes.

To ensure we can provide you with the best possible service, it is important to ensure your information is accurate, up to date and complete. Should there be any change to your Personal Information, we ask that you update us as soon as practicable. We will update your details upon receiving instructions from you to do so.

You may review, update, correct or delete the Personal Information on your bndr Account at any time. If you would like to correct your information or cancel your BNDR account entirely, you can do so by logging in to your account.

USE OF SERVICE BY CHILDREN

The bndr Service is not intended for children under the age of 13. When a visitor indicates an age under 13, the registration process for the bndr Service cannot be completed, and no personally identifying information is collected in conjunction with that attempted submission except that we retain e-mail addresses of such persons (and record of access attempts) for purposes of denying registration. Otherwise, we do not knowingly collect personally identifiable information from visitors under the age of 13. BNDR collects, uses and discloses information on users aged 13-18 in the same manner as it does for adults. If you are under the age of 18, you must obtain your parent’s permission before disclosing any information on the Service.

SECURITY

BNDR will protect Personal Information in its possession or under its control by making reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks.

bndr works with secure data networks protected by both industry-standard firewalls and passwords. We continuously implement and update security measures in order to safeguard your Personal Information. We also limit access to Personal Information to those bndr employees (and those employees of our affiliates) that we believe reasonably need to come into contact with that information to provide our products and services to you.

If a username and password is used to help to protect your account from unauthorised access, you must keep such login data confidential and must not disclose it or share it with anyone. We recommend that you select a unique and strong password to prevent unauthorised access to your account. If you have used a shared device, you must ensure that you sign out.

We work to protect the security of your information during transmission by using secure sockets layer software, which encrypts information you input. bndr will endeavour to take all reasonable steps to protect your Personal Information, however no method of transmission over the Internet and no method of storing electronic information can be 100% secure, and we do not guarantee the security of user information at any time.

Any third party that processes data on behalf of bndr shall, before commencing the processing of data, provide bndr with appropriate commitments and other adequate guarantees of the data security.

CHANGES TO THIS PRIVACY POLICY

bndr reserves the right to change this Privacy Policy at any time, with or without notice to you, by posting an updated version. The amended Privacy Policy will apply to you whether or not we have given you specific notice of any change. However, if we make changes which we believe are material, we will inform you of these changes. Your continued use of the bndr Services thereafter constituted acceptance of those changes.

We will occasionally update this Privacy Policy to reflect user feedback, legal requirements and changes in our services. We encourage you to review this Privacy Policy at regular intervals in order to be informed of how we are handling your information.

INCONSISTENCIES

Where there are any translations of this Agreement and to the extent of any inconsistency, the English version shall prevail.
